Escape Security User Agreement

(“User Agreement”)

By clicking “I Accept”, User agrees to the following:

  1. Definitions:
    1. Personal Information:  Personal Information means an individual’s first name or first initial and last name, in combination with any one or more of the following data elements:  Social Security Number; driver’s license or California identification card number;  account number, credit or debit card number, in combination with any required code or password that would permit access to the individuals financial account; medical information; health insurance information or medical information as defined by California Civil Code section 1798.29(g)(2) and (3); a username/email address in combination with a password or security question which would permit access to any online account of an individual.  Personal Information also includes any other such information obtained from the System which, if disclosed, would constitute an unwarranted invasion of a person’s privacy.  
    2. System: System means the Escape Financial Management Information System (FMIS). 
    3. User:  User means any individual assigned an Escape Financial Management Information System (FMIS) access card (“Security Card”) and PIN (Personal Identification Number(s)).

      Please Note:  Before you (User) export any Personal Information from the System, read the Best Security Practices Escape Best Security Practices to ensure that data you export is protected.

  2. Protection of Security Card:
    1. User agrees to reasonably protect User’s Security Card and PIN at all times. 
    2. User shall not transfer or lend his or her Security Card to anyone else.  If User no longer requires a Security Card, User will return it to his or her supervisor/manager who will notify School Business Advisory Services (“SBAS”) to deactivate the card.
  3. Access to and Non-Disclosure of Private Information:
    1. User’s access to an individual’s Personal Information on the System shall only be made in the performance of User’s assigned duties.   User shall only access the minimum necessary information to satisfy User’s job role or assignment. 
    2. Personal Information obtained from the System shall not be directly or indirectly disclosed to any third party, regardless of whether such disclosure is in oral, written or electronic form, unless such disclosure is authorized by User’s employer, supervisor or manager and necessary to the performance of User’s assigned duties.  Any authorized disclosure of Personal Information shall be in accordance with any applicable employer policies regarding the use and disclosure of such information. 
    3. Personal Information obtained from the System shall only be discussed in the work place and for job-related purposes.  Personal Information obtained from the System shall not be discussed outside of the work place or within hearing of other people who do not have a need to know about the information.   
    4. User’s obligations herein shall continue even after termination of User’s access to the System.  
    5. User shall promptly log off and close the Internet browser when not using the System.  
  4. Disclosure of Security Breach:
    1. Upon any actual or suspected loss, disclosure, or suspicion of compromise of User’s Security Card, User will immediately notify his or her supervisor/manager, who will notify SBAS.  SBAS will work with Information Technology Services (ITS) to issue a new card. 
    2. User shall immediately notify User’s supervisor/manager if User suspects or has knowledge that encrypted or unencrypted Personal Information has been disclosed to or acquired by an unauthorized person. 
    3. User shall immediately notify User’s supervisor/manager if User suspects or has knowledge that any encrypted or unencrypted computerized data has been compromised by any means of sharing or intrusion. 
  5. General Terms:
    1. This User Agreement shall be interpreted in accordance with California law, without giving effect to choice of law provisions.
